These Terms & Conditions (“Terms”) govern your use of ZYVAA AI (“ZYVAA”, “we”, “us”), an AI-powered Personal Health Intelligence platform. By creating an account, uploading a report, scanning food or subscribing to ZYVAA Pro, you accept these Terms and our Privacy Policy. If you do not agree, do not use ZYVAA.
1. Medical disclaimer — read this first
ZYVAA is an educational and informational wellness tool. It is not a medical device, not a diagnostic service, and not a substitute for professional medical advice, diagnosis or treatment. Biomarker extraction, compatibility scores, daily briefs, lifestyle suggestions, coaching answers and exported doctor reports are AI-generated interpretations and may be incomplete or wrong.
Always consult a qualified physician before acting on anything ZYVAA shows you — especially before changing your diet, medication, supplements, exercise or treatment plan. Never delay or disregard medical advice because of something you read in this app. If you believe you are having a medical emergency, contact emergency services immediately.
2. Eligibility and account
You must be 18 or older and legally able to enter a contract. You agree to provide accurate profile information, keep your credentials confidential, and accept responsibility for all activity under your account. Certain sensitive actions require a verified email address. Notify us through the in-app Feedback screen if you suspect unauthorised access.
3. Accuracy of what you provide
ZYVAA’s output is only as reliable as your input. You agree to upload only genuine health reports belonging to you, to record food honestly (including whether you actually ate an item), and not to impersonate another person or upload another person’s medical records without lawful authority.
4. AI limitations
AI extraction of biomarkers from PDFs and images, ingredient and nutrition analysis from photographs, and compatibility scoring can contain errors, omissions or misread values. Always verify important values against the original laboratory document and the product’s printed label. ZYVAA does not guess ingredient origins or invent values it cannot read; when confidence is low it will say so, and you should treat such output as unverified.
5. ZYVAA Pro subscription, billing and auto-renewal
ZYVAA Pro is a recurring subscription billed at ₹299 per month (inclusive of applicable taxes unless stated otherwise at checkout). Payments are processed by Razorpay Software Private Limited; by subscribing you also accept Razorpay’s terms for the payment instrument you choose.
Auto-renewal. Your subscription renews automatically at the end of each billing cycle using the mandate you authorised at checkout, until you cancel. Razorpay notifies you before each recurring debit as required by RBI e-mandate rules. The renewal date and amount are always visible on the in-app Subscription screen.
Cancellation. You may cancel at any time from Profile → Subscription. Cancellation stops future renewals; your Pro access continues until the end of the billing period you have already paid for, after which the account reverts to the free plan. Your health data is not deleted when Pro ends.
Refunds. Because ZYVAA Pro delivers AI processing immediately on activation, subscription fees are generally non-refundable once a billing cycle has begun. We will refund in full where: a duplicate charge occurred; a charge was taken after a cancellation was confirmed; or a verified platform failure prevented all Pro functionality for a material part of the cycle. Approved refunds are returned to the original payment method through Razorpay, typically within 5–10 business days. Request a refund through the in-app Feedback screen within 7 days of the charge, quoting the Razorpay Payment ID shown on your Subscription screen.
Price changes. We may change the price or plan structure with at least 30 days’ notice in the app. Changes never apply retroactively to a cycle you have already paid for, and you may cancel before the new price takes effect.
Failed payments. If a recurring debit fails, Pro features may be suspended until payment succeeds. Repeated failures may end the subscription.
6. Acceptable use
You agree not to: reverse-engineer, scrape, or resell any part of the service; attempt to bypass paywalls, rate limits or authentication; use the AI assistant to obtain prescriptions or to generate content unrelated to personal health; upload illegal, infringing or malicious content; probe the platform’s security; or use ZYVAA to provide clinical services to third parties.
7. Intellectual property
ZYVAA, its name, interface, design system, prompts, scoring logic, health-memory engine and report templates are our intellectual property and are protected by Indian and international law. You receive a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own health management.
Your content stays yours. You retain ownership of the reports, photographs and data you upload. You grant us a limited licence to process that content solely to operate the features you use, as described in the Privacy Policy. AI output generated for you may be used by you freely for personal, non-commercial purposes.
8. Service availability
We aim for continuous availability but do not guarantee uninterrupted service. Features may change, and dependencies (Firebase, the AI provider, Razorpay) may experience outages. Planned maintenance and material feature removals will be communicated in-app where practical.
9. Termination
You may delete your account at any time from Settings; deletion is irreversible and erases your health data. We may suspend or terminate accounts that breach these Terms, abuse the platform, or engage in fraudulent payment activity. Where we terminate without cause, we refund the unused portion of the current billing cycle.
10. Limitation of liability
To the maximum extent permitted by law, ZYVAA is provided “as is” and “as available” without warranties of any kind. We are not liable for medical outcomes, decisions taken on the basis of AI output, misread biomarker values, or indirect, incidental or consequential losses. Our total aggregate liability for any claim is limited to the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnity
You agree to indemnify ZYVAA against claims arising from your misuse of the service, your breach of these Terms, or your upload of data you were not authorised to share.
12. Governing law and disputes
These Terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka. Before initiating proceedings, you agree to raise the issue through the in-app Feedback screen so we can attempt a good-faith resolution within 30 days.
13. Changes to these Terms
We may update these Terms as the product and law evolve. Material changes are announced in-app before taking effect, and the effective date above is revised. Continued use after that date constitutes acceptance.
